The short version
- You own what you upload and what you generate.
- We use your content only to run Brandfeeler for you, and never to train AI models.
- Scores and insights are guidance, not guarantees. Clear trademarks before you adopt a name or logo.
- Cancel anytime. Your first subscription payment is refundable within 14 days.
- Texas law applies.
1. This agreement
These Terms of Service are an agreement between you and Brandfeeler ("Brandfeeler", "we", "us") for your use of brandfeeler.com, the Brandfeeler app and the services we provide through them (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you use the Service for a company, you agree for that company and confirm you can bind it.
2. Who can use Brandfeeler
You must be at least 18 years old. The Service is built for businesses and professionals, not for personal or household use. You are responsible for your account, for keeping your password private, and for what happens under it. Tell us right away at [email protected] if you think someone else has used it.
3. What the Service does
Brandfeeler helps you generate brand options (names, logos, palettes, type, copy, pages, decks and more), score them against criteria you set, and track them after launch. Many features use artificial intelligence models run by third-party providers, listed in our Privacy Policy.
Scores, verdicts, persona feedback, trademark lookups and other insights are guidance to support your decisions. They are not guarantees of results, and they are not legal, financial or professional advice. AI can be wrong, and you should review anything before you rely on it or publish it.
We change and improve the Service over time. We may add, change or remove features, and we will tell you in advance when a change materially reduces what a paid plan includes.
4. Your content and the license you give us
"Your Content" means what you put into the Service: briefs, notes, uploads (logos, images, screen recordings and files), links you submit, and anything else you provide. You keep all rights you have in Your Content.
You give us a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit and display Your Content and Outputs only as needed to run the Service for you: to generate and score what you ask for, to show it to you and to the people you share it with, to keep it safe, and to fix problems. This includes sending it to the AI and infrastructure providers that power the Service. The license ends when you delete the content or your account, except for copies we must keep by law and copies in backups, which are deleted on their normal schedule.
We do not use Your Content or Outputs to train AI models, and we do not sell them.
You confirm that you have the rights to everything you upload or submit, and that using it with the Service does not break any law or anyone else's rights.
5. What you generate
As between you and us, you own the outputs the Service generates for you ("Outputs"), and we assign to you any rights we may have in them. You can use them for any lawful purpose, including commercially.
Please keep in mind:
- AI models can produce similar outputs for different people, so an Output may not be unique to you.
- Some Outputs may not be protected by copyright in every country.
- We do not guarantee that a name, logo, tagline or other Output is free to use or to register. Before you adopt one, run your own trademark clearance and get legal advice where it matters.
6. Acceptable use
You agree not to:
- break any law, or upload or generate content that infringes someone's intellectual property, privacy or publicity rights;
- create content that is deceptive, defamatory, hateful, sexually explicit involving minors, or that impersonates a real person or organization in a misleading way;
- submit websites or files for analysis that you are not allowed to access or use;
- scrape, copy or resell the Service, or use it to build a competing product;
- reverse engineer the Service, get around usage limits or security, or disrupt it for others;
- share your account, or use automated means to create accounts or run the Service in ways we have not made available.
We may remove content or suspend accounts that break these rules.
7. Plans, credits and payment
Some features are free, and others need a paid plan or credits. Prices and what each plan includes are shown in the app before you buy. Payments are processed by Stripe; we do not store your full card details.
- Subscriptions are billed in advance for each billing period and renew automatically until you cancel. When you change plans, the difference is prorated.
- Credits pay for AI work such as generation and scoring. Credits that come with a plan apply to the billing period they are granted for, as described in the app. Credit packs you buy separately are added to your balance.
- Taxes are added where required.
- If a payment fails, we may pause paid features until it is resolved.
8. Cancellation and refunds
- Cancel anytime. You can cancel a subscription in your account settings. It stays active until the end of the period you have paid for, and it will not renew.
- 14-day refund on your first payment. If you are not happy, email [email protected] within 14 days of your first subscription payment for a full refund, as long as you have used no more than 10% of that period's credits.
- Renewals and partial periods are not refunded once the period has started.
- Credit packs can be refunded within 14 days of purchase if none of their credits have been used. After that, or once used, they are non-refundable.
- Failed work. If a generation fails because of a problem on our side, we do not charge credits for it, or we return them.
- Specialist Sprints and other services are scoped and priced in a written order. Unless the order says otherwise, you can cancel for a full refund up to 7 days before the agreed start date. After work starts, fees for work done are not refundable.
- Nothing here limits refund rights you have under law.
9. Third-party services
The Service connects to services run by others, such as sign-in with Google or GitHub, Slack, Stripe and the AI providers listed in our Privacy Policy. Your use of those services is also covered by their terms. We are not responsible for services we do not control.
10. Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
11. Ending this agreement
You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms, if we must by law, or if we stop offering the Service, and we will give you notice where we reasonably can. When your account ends, your right to use the Service stops, and we delete Your Content as described in our Privacy Policy. Sections 4 (the parts about what you confirm), 5, 10 and 12 to 16 continue after the agreement ends.
12. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that Outputs will be accurate, unique or fit for your purpose.
13. Limitation of liability
To the fullest extent the law allows, Brandfeeler is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars. These limits do not apply where the law does not allow them.
14. Indemnity
You will defend and indemnify Brandfeeler against third-party claims, and the costs that come with them, that arise from Your Content or from your breach of these terms.
15. Governing law
These terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Any dispute will be decided by the state or federal courts located in Texas, and you and we agree to their jurisdiction.
16. Changes and general terms
We may update these terms. If a change is material, we will tell you by email or in the app at least 14 days before it takes effect. If you keep using the Service after that, the new terms apply. These terms, the Privacy Policy and any order you sign with us are the whole agreement between us. If a part of these terms cannot be enforced, the rest still applies. If we do not enforce a right, we have not given it up. You may not transfer this agreement without our consent; we may transfer it as part of a merger, acquisition or sale of assets.
